GENERAL INFORMATION

The State of New Mexico imposes a weight-distance tax on owners, operators and registrants of intrastate and interstate Commercial Motor Vehicles (CMVs) with a declared weight of 26,001 pounds. The tax is based on vehicle weight and miles traveled on New Mexico roads.

Companies and individuals must register the tax annually by December 31. Each entity subject to weight- distance tax must file a New Mexico weight-distance tax return on a quarterly basis and pay the tax due to the Motor Vehicle Department.

WHAT IS THE NEW MEXICO WEIGHT-DISTANCE TAX?

The Weight-Distance Tax (WDT) is a quarterly tax based on the:

  • Weight of your vehicle (gross weight), and
  • Distance traveled on New Mexico highways.

It is mandatory once your permit is approved and your vehicles travel within the state.

New Mexico (NM) permits are issued to regulate the operation of commercial motor vehicles (CMVs) on state highways. These permits are primarily associated with the New Mexico Weight Distance Tax (WDT) and oversize/overweight vehicle requirements. The permits ensure compliance with the New Mexico Motor Transportation Division (MTD) and New Mexico Taxation and Revenue Department (TRD) regulations.

How Often Is It Paid?

The Weight-Distance Tax is due on a quarterly basis.

Filing deadlines are:

  • April 30 January – March
  • July 31 April – June
  • October 31 July – September
  • January 31 October – December

The New Mexico Permit Application, New Mexico Weigh-Distance Tax, can now be processed through the Federal Applications Processor for commercial motor vehicles weighing 26,001 pounds or more engaged in both interstate and intrastate commerce within the New Mexico state lines.

PENALTIES FOR NON-COMPLIANCE

Penalties are imposed on motor carriers who operate in the state without the necessary permits, fail to file reports, or do not pay the required taxes. Penalties include:
